These Terms of Service ("Terms") govern your use of the Asgard Fleet LLC website and vehicle rental services. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Services Description

Asgard Fleet LLC provides vehicle rental services through our website and third-party platforms, including:

• Vehicle rental bookings and reservations
• Customer support and assistance
• Vehicle information and availability
• Contact and communication services

3. Eligibility

To use our services, you must:

• Be at least 21 years old (25+ for premium vehicles)
• Have a valid driver's license
• Provide accurate and complete information
• Comply with all applicable laws and regulations

4. Vehicle Rentals

4.1 Booking and Reservations

Vehicles are rented directly from Asgard Fleet LLC. Payment is accepted by credit/debit card (via Stripe), Venmo, or cash. By booking a vehicle, you agree to:

• Provide accurate booking information
• Pay all applicable fees and charges
• Return the vehicle in the same condition as received
• Follow all traffic laws and safety regulations
• Comply with the terms of the Rental Agreement

4.2 Vehicle Condition and Maintenance

All vehicles are maintained to high standards and are inspected before each rental. You are responsible for reporting any damage or issues immediately upon pickup.

4.3 Insurance and Liability

All Asgard Fleet vehicles are covered by Asgard Fleet LLC's commercial insurance. At booking, the Lessee selects a protection plan that determines the security deposit and the Lessee's maximum out-of-pocket responsibility for damage to the Vehicle:

• Use Your Own Insurance — no daily charge, $1,000 deposit; Lessee's own qualifying auto policy is primary and Lessee is responsible up to $1,000.
• Standard Protection — $45/day, $500 deposit; Lessee's damage responsibility is capped at $500.
• Premium Protection — $65/day, no deposit; Lessee's damage responsibility is $0.

If the Lessee selects Use Your Own Insurance, the Lessee must maintain a valid personal auto policy that extends to the rented Vehicle (liability at California minimums or higher, collision, comprehensive, and uninsured/underinsured motorist property damage, including hit-and-run) and present proof of coverage at pickup. Standard and Premium Protection do not require the Lessee to carry personal auto insurance for damage to the Vehicle.

Regardless of plan, the Lessee is fully responsible (no coverage) for damage caused by prohibited use, driving under the influence, reckless or negligent driving, off-road use of non-Jeep vehicles, intentional damage, or racing. The security deposit may be applied toward the plan deductible, cleaning fees, tolls, tickets, loss-of-use, towing, storage, or any unpaid amounts.

5. User Conduct

You agree not to:

• Use our services for any illegal or unauthorized purpose
• Violate any applicable laws or regulations
• Interfere with or disrupt our services or servers
• Attempt to gain unauthorized access to our systems
• Provide false or misleading information
• Use our services to harm others or their property
• Violate the terms of service of any third-party platforms we use

6. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Asgard Fleet LLC or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

7. Third-Party Services

Our services integrate with third-party platforms and services, including:

• Stripe: Payment processing and security deposits
• Calendly: Appointment scheduling
• Google reCAPTCHA: Security and spam protection
• Email Services: Communication and marketing

These third-party services have their own terms of service and privacy policies. You are responsible for complying with their terms when using their services.

8. Disclaimers and Limitations

8.1 Service Availability

We strive to provide reliable services but cannot guarantee uninterrupted availability. We reserve the right to modify, suspend, or discontinue our services at any time.

8.2 Limitation of Liability

To the maximum extent permitted by law, Asgard Fleet LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of our services.

8.3 Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Indemnification

You agree to indemnify and hold harmless Asgard Fleet LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of our services or violation of these Terms.

10. Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use our services will cease immediately.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the jurisdiction of the California courts, with venue in Sacramento County, California. Disputes under $10,000 shall be resolved through binding arbitration conducted in Sacramento, California.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of our services after any changes constitutes acceptance of the new Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

14. Entire Agreement

These Terms constitute the entire agreement between you and Asgard Fleet LLC regarding the use of our services and supersede all prior agreements and understandings.
